Man Found "Not Guilty" In Infant's Death

ODESSA--It was a day of relief for once accused baby killer John Bailey as he was found not guilty in the death of 5-week-old Dustyn Wright.

Bailey was arrested in 2010 two years after Wright's death in 2008. While this trial was considered "high profiled" jurors say the lack of fact and witness testimony contributed to the not guilty verdict.

Beyond a reasonable doubt is the standard jurors are expected to stick to. Juror Malyssa Taylor said that's what she and the other 11 jurors did.

 "It can't be just maybe 70 percent or 30 percent. It has to bee 100 percent or nothing," said Taylor.Taylor said it was a heartbreaking case to be a part of considering the victim.

"I know all of us, our hearts dropped when we heard our names called because no one wants to be a part of but you want to see justice served," said Taylor.

Taylor went on to say the verdict was hard to give knowing no one would be put away for the baby's death.

The whole ordeal began in 2008 when baby Wright was airlifted to an El Paso Hospital with severe head injuries. Bailey was named in the case. Taylor said despite the claims the evidence just wasn't there.

"I was a little disappointed. I thought maybe we'd here a little more evidence."

Taylor said changed stories ad he said she said testimony further aided in the verdict.

"We were just waiting for the smoking gun just to let you know, yeah he did it, but there was nothing concrete that could lead us in that direction," said Taylor.
