Trial Delayed For Odessa Man Accused Of Killing 5-Year-Old

ODESSA -- A capital murder trial against an Odessa man accused of killing a 5-year-old boy has been delayed.

    The trial against Ralph Martinez, Jr. has been delayed until April 2013. The trial was originally slated to begin in February 2013.

    Defense attorneys asked for an 8 month extension to prepare their case, but 244th District Judge James Rush gave a 2 month delay instead.

    Martinez, 26, and Kimberly Ann Moore, 28, were both indicted on charges of capital murder and 6 counts of injury to a child on April 18, 2011.

    Martinez and Moore are accused of killing Zachary Dominguez.

    Dominguez, 5, died after he was rushed to Medical Center Hospital with cardiac arrest on February 19, 2011.

    An autopsy and an arrest affidavit both reportedly showed that Dominguez had bruises and burn marks all over his body.

    Dominguez's brother -- who was 2-years-old at the time -- reportedly had similar bruises and markings.

    If convicted, Martinez and Moore could face the death penalty.
