Ector County Sheriff's Deputy Not Charged For Fatal October 2012 Shooting

ODESSA -- An Ector County Sheriff's deputy won't face charges for a fatal October 2012 shooting.

    An Ector County grand jury no-billed Johnny Valderaz Monday.

    Valderaz shot and killed Marvin Donald Wilkerson during a disturbance in the 4000 block of Uranus Avenue in West Odessa around 7:15 PM on October 31st.

    Ector County Sheriff's deputies were called to the scene due to a report of a man waiving a silver gun threatening people.

    Ector County Sheriff's deputies say that Valderaz shot Wilkerson, 66, in self-defense after Wilkerson tried to pull a gun out of his waistband.
   
    Neighbors on the scene told Big 2 that Wilkerson might have been under the influence of alcohol at the time.

    The Texas Rangers investigated the incident and determined that the shooting was justified.

    Even with Monday's no-bill Valderaz has had run-ins with the law before.

    Valderaz had to resign from the Odessa Police Department in February 2010, after Texas Rangers opened in investigation to look into accusations that he attacked his ex-girlfriend.

    Valderaz was ultimately acquitted of the charges in April 2011.
