Midland Rape Kit Trial Posponed

MIDLAND -- The trial date for a Big Spring man accused of having a rape kit in his car has been pushed back.
    Juan Jose Guerra was supposed to stand trial Monday, but District Judge Robin Darr postponed the start date to January 10th. Guerra, 49, was arrested in April 2010 after police reportedly saw him driving slowly past a church in Midland where children were playing outside. Guerra allegedly had a rape kit in his car, including Viagra, a stun gun, a makeshift gag and zipcuffs.
    Guerra was charged with four counts of possession of a criminal instrument with the intent to commit aggravated sexual assault. He faces two to 20 years for each count if convicted.
