Rape Kit Trial Date Pushed Back Again

MIDLAND -- A trial for a Big Spring man accused of driving around Midland with a rape kit has been pushed back.

    Juan Jose Guerra was originally supposed to stand trial in November 2010, but District Judge Robin Darr pushed back the trial date. Now, Big 2 has learned that the trial won't start until March 7th.

    Guerra, 49, was arrested in April after police said they saw him drive slowly by a church in the Tall City. Kids were reportedly playing outside that church at the time.

    Police say Guerra had Viagra, a stun gun, a makeshift gag and zipcuffs in his vehicle. He was charged with four counts of possession of a criminal instrument with the intent to commit aggravated sexual assault.   

    Guerra faces up to 20 years in prison for each count, if he is convicted.
