English proficiency is a requirement to sit on an Ector County jury. Since one of the jurors in the case against Johnny Lee Wells could not meet this requirement, the defense asked for a mistrial. The judge in the case granted the motion.
Wells is charged with the 1990 murder of Virginia Washelesky. Ector County District Attorney Bobby Bland is anxious to take him to trial.
"We were ready to go forward," Bland told Big 2. "We opposed the mistrial but we certainly understood the judge's decision in this case, and we were ready to proceed. We'll be ready when the time comes in a few weeks."
If convicted, Wells faces life behind bars. Bland says he expects a new trial will start in two weeks to a month.
