Former Permian Quarterback Lawsuit Moving Forward

ODESSA -- The lawsuit filed by a former Permian High quarterback against a local college is moving forward.

    Tate Smith is suing Odessa College and Dessie Davis, after he got a failing grade in a summer English class at the school. The failing grade led to Smith losing his scholarship at the University of New Mexico.

    The lawsuit centers around a disputed paper in the class. Smith says he turned the paper in, while Davis (his instructor) says she didn't get the paper.

    Now, the debate has centered around whether or not Smith turned the paper in in the right format, and if the instructor could or couldn't open it.

    Odessa College tried to get the suit dismissed, but the judge denied the request -- after Smith sent in a more detailed complaint upon request.
