A Nolan County District Judge ruled that Carlos Rico had a psychotic episode when he allegedly tried to strangle his 4-year-old son and left him for dead along Interstate 20.
The boy was later rescued, although his custody is still up in the air.
Rico was later arrested near the Dallas-Fort Worth Metroplex and charged with endangering a child, injury to a child and attempted capital murder.
Rico reportedly said he heard voices telling him to kill his son -- and the judge felt that he wasn't in a clear state of mind.
Now, Rico will be evaluated in a state hospital for up to 30 days to see if he's a threat to the public.
