Tobacco Warnings Violate Constitution

Washington, DC  --  Cigarette manufacturers have a win in their lawsuit challenging a tough new label requirement.

   A federal judge says the FDA's rule requiring large stark images on cigarette packages violates constitutional free speech rights.

   The nine images include photos of diseased lungs and rotted teeth.

   District Judge Richard Leon said the Food and Drug Administration rule is too broad.

   Last year, the Washington, DC, judge granted an injunction which kept the FDA from enforcing the labelling rule.
