Major Environmental Trucking Case Could Go To Trial In West Texas

Ector County and the State of Texas filed suit against Quell Petroleum Services Inc.
The suit claims that Quell knowingly drove a vehicle that was leaking used motor oil along Interstate 20 in Midland and Ector counties.
A motorcyclist who was heading down Loop 250 at the time of the spill claims he slipped on the oil and crashed his motorcycle.
Quell voluntarily removed that truck from service, and they are working to resolve the lawsuit.
However, an attorney for the motorcyclist filed a plea to place personal injuries into the existing environmental case.
A change of venue request for the case could move the case from Travis County to Ward, Midland, or Ector Counties.
If the motorcyclist wins in the lawsuit, people injured in pollution accidents might be able to piggyback on city, county, or state actions to enforce anti-dumping laws.
