MIDLAND -- A man accused of running over a sleeping man in a Midland field last month won't face charges for the incident.

Midland Police say that Donald Lee Gregory was sleeping in a weed patch in a vacant field in the 1900 block of North Loop 250 West (between Corley Paper and Tracker Boats) when a when a blue truck tractor -- which was pulling a sand hauler belly-dump style trailer -- ran over him around 8:45 AM on November 21st.

Gregory reportedly woke up in great pain.

The truck and trailer reportedly drove off toward Loop 250 after the incident.

Gregory lay in the field for several more hours until a passerby saw him and called 911.

Gregory was then rushed to Midland Memorial Hospital with serious injuries.

As of Thursday, Gregory was listed in stable condition at M.M.H.

Police say that they found the truck tractor believed to be involved in the incident on December 4th.

The truck tractor parked unattended in the same field where the incident took place .

Officers then tracked down and interviewed the driver and trucking company owner on December 5th.

Police say that the driver claimed that he didn't see Gregory lying in the field, and he was unaware that he ran Gregory over.

With the updated information in mind, officers say they won't be charging the truck driver.
