MIDLAND -- An embattled West Texas mayor is out of jail.

Bartolo Sanchez posted $100,000 bond on December 19th.

As a condition of his bond, Sanchez must resign his post as Toyah mayor.

Sanchez is facing federal charges for aggravated identity theft (4 counts), wire fraud and bank fraud.

Sanchez allegedly bilked the City of Toyah out of about $300,000 by writing checks to himself from city funds.

Sanchez will next be in federal court on January 2, 2013.
