CARLSBAD, NM -- A trial against a Carlsbad, NM man accused of killing a 20-month-old girl in 2004 has been declared a mistrial.

The Carlsbad Current-Argus reports that District Court Judge Jane Shuler Gray declared a mistrial in the trial against Curtis Jones on Monday.

Jones, 26, is accused of killing 20-month-old Amy May in 2004.

Medical examiners reportedly stated that May died of blunt force trauma to the head, but they also believe that she was raped.

The mistrial was called because Gray had questions about credibility of Dr. Paul Shrode of Lubbock, who performed the autopsy on May.

As of Monday, no new trial date had been named.
