UPDATE: Midland Apartment Shooting, Gunshot Victim Recovering

UPDATE:
Officers found 34 year-old Toby Stewart on the patio of apartment #2407. He had been shot once with a 45-caliber pistol. The gunshot wound was located on the upper right part of his chest and shoulder.
Preliminary investigation indicates an argument broke out between Stewart and a female who were both attending a get-together at the apartment. The female had another male friend pick her up from the apartment. An altercation occurred in the parking lot between to the two males, which led to Stewart being shot.
Stewart returned to the apartment and waited for emergency medical personnel and police to arrive.
Stewart was transported to Midland Memorial Hospital and treated at the emergency room. It is unknown if Stewart has been released or admitted.
The identity of the shooter is known and detectives are working on securing a warrant for the arrest of the shooter for Aggravated Assault with a Deadly Weapon.
The investigation continues.

A Midland man was rushed to the hospital after being shot at a Midland apartment complex.
According to Sgt. David Garcia with the Midland Police Department, the shooting happened just before midnight on Tuesday at the Northridge Apartment Complex.
Apparently, the victim, Toby Stewart, and his girlfriend's ex-boyfriend were in a fight and things got heated and quickly turned physical. Stewart was shot in his upper chest area. As things stand now, police know who the shooter is, but they are waiting to release the suspect's name until they obtain an arrest warrant. We're told Stewart is recovering.
