Man Convicted in Attempted Odessa Robbery Has Sentence Upheld

One of the three men who pleaded guilty to conspiring to rob an armored truck in Odessa has had his sentence upheld by a federal appeals court.
Joshua Bell's defense told the court that U.S. District Judge Rob Junell abused his discretion by imposing a prison term that was 10 years more than the sentencing guidelines. But according to The Odessa American, the Fifth Circuit Court of Appeals found that Junell had the discretion to make the changes.
The two other defendants - Preston Savell and Christopher Simmons - also pleaded guilty last year. They were both sentenced to almost 26 years in prison. Savell's appeal has been denied. Simmons' is still pending.
