KERMIT -- Winker County Attorney Scott Tidwell has filed a non-suit motion to dismiss a petition to remove Winkler County District Attorney Mike Fostel from office.

Tidwell had filed that petition against Fostel in late December. The motion to dismiss that petition was filed on Tuesday and follows Tidwell's arrest on retaliation charges. Those charges were tied to a 2009 incident involving two nurses at the Winkler County Hospital.

Big 2 asked Fostel how he felt about the petition being dropped.

"I'm very happy about it," he said.
