Justice Department Files Brief Against Same Sex Marriage Ban

The Obama administration has formally expressed support for same-sex marriage in California.

The Justice Department filed a legal brief with the U-S Supreme Court Thursday challenging California's same-sex marriage ban.

The brief states gay and lesbian couples have the same "equal protection" rights to wed and that voters in California didn't have the power to take those rights away.

An appeal in the California Proposition 8 case was submitted after-hours with the Supreme Court, which is expected to hear the issue in March.
